Terms and Conditions for Digital Ebook

These Terms and Conditions ("Agreement") govern your purchase and use of the digital ebook titled "AI Without the Hype: The Full Playbook" (the "Ebook") provided by Giovanni Rufino, an individual operating at georufino.com ("Provider," "we," "us," or "our"). By purchasing, downloading, or using the Ebook, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not purchase, download, or use the Ebook.

1. License Grant

1.1. Upon successful payment, the Provider grants you a non-exclusive, non-transferable, revocable license to access and use the Ebook in your own business. Your employees may use the Ebook within that business.

1.2. This license does not grant you any ownership rights in the Ebook. All intellectual property rights, including copyrights, in the Ebook remain with the Provider.

1.3. Independent Work and Affiliations. The Ebook is the independent personal work of Giovanni Rufino and is not affiliated with, sponsored by, or endorsed by his employer. Furthermore, the Ebook and its sale are not affiliated with, sponsored by, or endorsed by Mitchell Community College, any Small Business Center, or the NC Small Business Center Network.

2. Product Description

2.1. The Ebook, titled "AI Without the Hype: The Full Playbook," is a single PDF file (US Letter size) delivered as a digital download. It is a plain-language guide for small business owners, solopreneurs, and managers on safely using AI tools. The Ebook includes guardrails for using AI, a fill-in business profile template, copy-and-paste prompts, worksheets, a guide to nine categories of AI tools with neutral criteria for choosing one, a section on spotting scams and fake AI services, and a dated list of real companies that offer each kind of tool, with links to their official websites. No physical goods, software, user accounts, or subscriptions are included with the purchase of the Ebook.

3. Restrictions on Use

3.1. You may download the Ebook file, keep copies on your own devices, print copies for use within your business, and copy the Ebook's templates, prompts, and worksheets into your own AI tools, documents, and business records. You may not resell the Ebook or share, post, or distribute copies outside your business. Your copy may include a customer-specific stamp added by Gumroad.

3.2. You must not:

Remove any copyright, trademark, or other proprietary notices from copies of the Ebook.
Circumvent or disable any digital rights management (DRM) or other technological protection measures applied to the Ebook.
Share, lend, rent, or sublicense the Ebook to any third party outside of your business.
Resell the Ebook or publish its content as your own.

4. Payment and Refunds

4.1. The price for the Ebook is 29 USD. All payments are processed through Gumroad, which acts as the merchant of record, processes payments, collects and remits sales tax, issues receipts, and delivers the download. Payment-related matters are also governed by Gumroad's own terms and conditions.

5. Disclaimer of Warranties

6. Limitation of Liability

Our total liability is limited to the amount you paid us for the Ebook.

7. Indemnification

7.1. 8. Governing Law and Jurisdiction

All matters relating to the Ebook and these Terms and Conditions, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of North Carolina without giving effect to any choice or conflict of law provision or rule.

8.2. Any legal suit, action, or proceeding arising out of, or related to, these Terms and Conditions or the Ebook shall be instituted exclusively in the state courts in Franklin County, North Carolina, or the federal courts for the Eastern District of North Carolina. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

9. Entire Agreement

9.1. These Terms and Conditions constitute the sole and entire agreement between you and the Provider regarding the Ebook and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Ebook.

10. Privacy

10.1. We collect personal information necessary to process your purchase and deliver the Ebook, such as your name and email address. This information is handled in accordance with Gumroad's privacy policy and the Provider's privacy policy at georufino.com/privacy. The Provider may email buyers about updated editions of the Ebook through Gumroad. We do not share your personal information with third parties for marketing purposes, and the Provider does not sell personal information.

11. Updates to the Ebook

11.1. Buyers receive updated editions of the Ebook at no extra charge through Gumroad for as long as the Provider maintains the guide. There is no guaranteed schedule for updates, and the Provider may cease updating the Ebook at any time.

12. Miscellaneous

12.1. Age Requirement. Purchasers must be 18 years of age or older.

12.2. Group Licenses. Organization or group licenses are available only by separate written agreement with the Provider.

12.3. Changes to Terms. The Provider reserves the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting the revised Terms and Conditions on georufino.com. Your continued use of the Ebook after such modifications will constitute your acknowledgment of the modified Terms and Conditions and agreement to abide and be bound by them.

12.5. Trademarks. All company and product names mentioned in the Ebook are trademarks or registered trademarks of their respective owners.
